Terms & Conditions

MINIMUM RENTAL PERIOD:

1 day (24 hours). Any fraction of 24 hours is considered a full rental day.

DRIVING LICENCE:

A valid driving licence recognised in Portugal is mandatory.

DRIVER AND RENTER AGE:

Minimum age is 21 years, with at least one year of driving experience.

FUEL / ELECTRIC CHARGING:

Fuel and/or electric charging are the responsibility of the customer (renter). 7M RENT A CAR is responsible for the vehicle’s maintenance and roadside assistance.

INSURANCE:

Prices include Third Party Liability Insurance valid in Portugal. The customer (renter) is responsible for any damage caused to the rented vehicle up to the maximum amount of the deductible (excess) applicable to each incident.

This responsibility may be reduced or eliminated by paying an additional fee of xxx EUROS per day, according to the public price list available at our counter on the date of the rental.

The customer (renter) will always be fully responsible for any damage caused to third parties or to the rented vehicle whenever the vehicle:

Is driven by a person who is not legally licensed or not authorised by 7M RENT A CAR;

Suffers damage intentionally caused by the customer (renter) or by any person for whom the renter is responsible;

Is driven by a person under the influence of alcohol, narcotics, drugs, toxic products or in a state of mental incapacity;

Suffers abnormal wear on the clutch and/or gearbox, or when there is loss of keys, wrong fuel usage, or damage to the interior of the vehicle;

Is used in sporting events, races, rallies, challenges, competitions, bets, etc.;

Is involved in an accident that is not reported in writing to 7M RENT A CAR as soon as possible.

Failure to report, or late reporting of an accident, creates for the customer (renter) the obligation to indemnify 7M RENT A CAR for all additional expenses resulting from that omission.

PERSONAL ACCIDENT INSURANCE (PAI):

Please request further information from 7M RENT A CAR.

PAYMENT:

The estimated cost of the rental must be paid at the time the vehicle is delivered – minimum €500.00 – with the final balance settled at the end of the contract. Additional guarantees may be required.

DELIVERY AND COLLECTION:

Deliveries and collections carried out outside our offices are subject to an additional fee;

Deliveries/collections at the airport are subject to a fee according to the conditions in force;

In both cases, the prices for these services are shown in our public price list available at the counter on the date of the rental;

7M RENT A CAR is not responsible for unused rental days nor for any losses resulting from non-compliance with contractual requirements;

Vehicles must be collected in good condition, as they were delivered to the renter, including cleanliness. If this is not the case, 7M RENT A CAR has the right to be reimbursed for the amount necessary to restore the vehicle to suitable condition for the next customer.

TRAVEL TO PORTO SANTO:

Rental prices do not include travel outside Madeira Island.

Travel to Porto Santo may be authorised by 7M RENT A CAR upon payment of an extra fee, which will be mentioned in the rental contract.

If 7M RENT A CAR becomes aware that the vehicle has left Madeira Island without prior authorisation and without payment of the applicable fee, the customer (renter) will be penalised in the amount of €3.00 for each kilometre driven during the rental period and will be responsible for any damages that may occur to the rented vehicle.

FINES AND PENALTIES:

All fines, penalties or tickets issued during the rental period are the sole responsibility of the customer (renter).

RENTAL PERIOD – EXTENSION:

The rental ends on the day, time and place agreed in the contract.

If the customer (renter) wishes to extend the rental, they must contact 7M RENT A CAR in advance, at least 24 hours before the end of the contract, so that 7M RENT A CAR may authorise the extension.

If no authorisation is granted, the vehicle will be considered to be in circulation without permission and against the will of 7M RENT A CAR, which may report the situation to the authorities, punishable under the Portuguese Highway Code and Criminal Law.

VEHICLE OCCUPANCY:

It is not permitted to exceed the maximum number of passengers indicated in the vehicle registration (DUA).

ACCIDENTS:

In the event of an accident, the customer (renter) must:

Call the police, and if there are injured persons, call an ambulance;

Not move the vehicle(s) before taking photographs of the accident scene and positions of the vehicles;

Contact and immediately inform the nearest 7M RENT A CAR office or the head office in Funchal (telephone number indicated in the rental contract);

Obtain from the other driver(s) involved:

Name, address and telephone number;

Driving licence number, place and date of issue;

Insurance company and policy number;

Names and addresses of any witnesses;

Correctly fill in all sections of the European Accident Statement (DAAA) form that is inside the vehicle, together with the vehicle documents.

BREAKDOWNS:

In the event of a breakdown, the customer (renter) must immediately contact the nearest 7M RENT A CAR office between 08:30 and 23:59.

Outside these hours, the customer must contact the roadside assistance service indicated in the contract and provide the following information:

Name;

Vehicle registration number, make and model;

Rental contract number;

Number of persons in the vehicle;

Exact location of the breakdown;

Details of the breakdown.

7M RENT A CAR is not responsible for loss of time or any inconvenience caused by accidents or breakdowns that may delay or interrupt the customer’s holiday or trip.

DOCUMENTS:

7M RENT A CAR provides the customer (renter) with all the vehicle documents in a specific folder.

In case of loss of these documents during the rental period, the customer is considered responsible and must pay the amount of €100.00 for issuing new documents.

The customer (renter) is also responsible for any fines arising from driving the vehicle without the required documents.

JURISDICTION:

Both parties agree that any dispute arising from this contract shall be submitted to the Judicial Court of the District of Funchal, expressly waiving any other jurisdiction.
